BIS updates key export control enforcement guide with new cases
The US Commerce Department’s Bureau of Industry and Security (‘BIS’) has released an updated version of its enforcement guide ‘Don’t Let This Happen to You!’, featuring recent case examples of export control violations, the agency announced 12 November.
The revised publication, last updated in July 2024, includes several significant new enforcement cases, including:
● The first penalty case from the Disruptive Technology Strike Force
● A criminal case involving a Russian procurement network
● A smuggling case where export-controlled items were used in an assassination plot
● An administrative action against a semiconductor company for unauthorised shipments to an Entity List party
● Violations of antiboycott regulations
‘Exporters are encouraged to review the publication, which provides useful illustrations of the type of conduct that gets companies and universities in trouble,’ BIS advised.
The guide aims to help industry and academia understand export control compliance requirements through real-world examples of enforcement actions, it said, explaining: ‘BIS Export Enforcement protects and promotes U.S. national security by aggressively investigating violations of export control and antiboycott regulations and by partnering with industry and academia to facilitate compliance with those regulations.’
The agency encouraged reporting of suspected export violations through its online tip portal, enforcement hotline or by email.
